Terms of Service

These Terms of Service ("Terms") govern your use of FitOut Alerts NYC (the "Service"), operated by Siringo Inc., a Wyoming corporation, 42 Broadway Suite 1227-631, New York, NY 10004 ("Siringo", "we", "us"). By signing up for or using the Service you agree to these Terms. If you use the Service for a company, you confirm you may bind that company.

1. The Service

The Service is a business-to-business data subscription that delivers email digests (and, on some plans, CSV files) of NYC commercial construction leads and public bid notices, filtered by borough and trade. It is intended for business use, not for consumers.

2. Data source; no affiliation

Lead data comes from public records published by the City of New York on NYC Open Data, including NYC Department of Buildings permit and filing data and the City Record. We filter, classify and format it. Siringo Inc. is not affiliated with, endorsed by, or acting for the City of New York or any of its agencies.

3. Free trial

New subscribers get a 14-day free trial. No card is needed for the trial. On or around day 12 we email you a payment link to continue. If you don't complete payment, the trial ends and you aren't charged.

4. Subscription, billing, cancellation and refunds

Paid plans are billed monthly in advance at the price shown when you subscribe (currently $99/month for one borough and $249/month for all five boroughs plus CSV). Payments are processed by our payment processor, Stripe. Cancel anytime; billing stops at the end of your current paid month. No partial-month refunds. We may change prices with at least 30 days' email notice; changes apply from your next billing period.

5. Acceptable use

You may use the digests and CSV files internally for your own business development. You may not:

• resell, sublicense, publish, or redistribute the Service's digests, CSV files, or compiled data to third parties, or offer them as part of a competing lead or data product;
• share your subscription with people outside your company;
• scrape, overload, or interfere with the Service or our website;
• use the data for unlawful purposes, including harassment, or in violation of telemarketing, anti-spam, or privacy laws. You are responsible for your own outreach to contacts listed in the data.

The underlying public records stay public. This restriction applies to our compiled, filtered, and formatted outputs.

6. No warranty

Public data can be late, incomplete, or wrong, and our classification is automated. THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Check important facts (for example with NYC DOB) before relying on them.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIRINGO INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

8. Suspension and termination

We may suspend or end your access if you breach these Terms, for example by redistributing data. You may stop using the Service at any time by cancelling or unsubscribing.

9. Changes

We may update these Terms. If a change is material we'll email subscribers or post a notice, and the "Last updated" date will change. Continuing to use the Service means you accept the updated Terms.

10. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute will be heard exclusively in the state or federal courts located in Wyoming, and both parties consent to their jurisdiction.
